			<content:encoded><![CDATA[<p><strong>A 66-year-old church elder convicted of indecently assaulting a child will not be sent to jail because his obesity means his health is &#8220;precarious&#8221;.</strong></p>
<p>John William McConaghy, from Urbal Road, Dervock, County Antrim, was found guilty of indecent assault.</p>
<p>Judge David Smyth at Antrim Crown Court suspended a two-and-a-half year term.</p>
<p>He said McConaghy&#8217;s lack of mobility, ulcerated legs and need for frequent dressings amounted to &#8220;wholly exceptional circumstances&#8221;.</p>
<p><!-- E SF -->The jail term was suspended for three years and a £10,000 fine was also imposed.</p>
<p>During a 10-day trial in October McConaghy&#8217;s victim, who is now 44, said she was indecently assaulted from the age of around 10 until she was 18.</p>
<p><strong>&#8216;Not happy&#8217;</strong></p>
<p>She said that she was assaulted so often it became &#8220;the norm&#8221;.</p>
<p>She said McConaghey&#8217;s abuse &#8220;petered out&#8221; as she reached adulthood and struck back at him, scratching his face as she fought him off.</p>
<p>Speaking after the sentencing the woman said was &#8220;not happy&#8221; he was freed, but nevertheless understood the reason why.</p>
<p>&#8220;I am happy with the sentence he got, I think that was a fair sentence, but I am not happy with the suspension of it, but I understand the reason for it on medical grounds.&#8221;</p>
<p>She added that she was glad she had pursued the case against him, &#8220;because everybody now knows, church elder or not, what he is&#8221;.</p>

			<content:encoded><![CDATA[<p><strong>Solicitors who took millions of pounds from compensation payouts given to sick miners have lost their appeal against being struck off for misconduct.</strong></p>
<p>James Beresford and Douglas Smith, formerly of Doncaster-based Beresfords Solicitors, had denied 11 counts of serious professional misconduct.</p>
<p>A tribunal last year found eight of the allegations against them proven.</p>
<p>Three High Court judges have now upheld the tribunal decision to strike them off the Roll of Solicitors.</p>
<p><!-- E SF -->The Solicitors&#8217; Disciplinary Tribunal was told last year that the men had acted &#8220;unacceptably&#8221; by charging clients even though the government was paying their fees.</p>
<p>The partners were later struck off the Roll of Solicitors for conduct unbefitting solicitors.</p>
<p><strong>&#8216;Vulnerable clients&#8217;</strong></p>
<p>High Court judges ruled on Wednesday that the tribunal had been entitled to make &#8220;a cumulative series of findings of very serious misconduct on a huge scale in relation to thousands of vulnerable clients&#8221;.</p>
<p>Beresford, 59, who was said in 2007 to be one of Britain&#8217;s highest-earning solicitors, and Smith, 53, made millions of pounds from personal injury claims for miners under the government&#8217;s coal health compensation scheme.</p>
<p>They were accused of not giving adequate advice and entering into contingency fee deals against their clients&#8217; best interests.</p>
<p>The tribunal heard that up to 30% of a miner&#8217;s damages could be deducted by Beresfords.</p>
<p><strong>&#8216;Nothing wrong&#8217;</strong></p>
<p>The law firm had argued there was &#8220;absolutely nothing wrong&#8221; with earning substantial fees from its business conduct.</p>
<p>The compensation scheme was set up by the government to settle group legal actions for damages after the High Court ruled in 1998 that British Coal was liable in negligence for causing serious debilitating diseases in miners.</p>
<p>The scheme related to hundreds of thousands of claims from former miners and their families and involved the Department of Trade and Industry agreeing to pay lawyers&#8217; fees in successful cases. In unsuccessful cases miners did not have to bear costs.</p>
<p>Beresford and Smith&#8217;s joint earnings went from about £182,000 in 2000 to £23,273,256 in 2006, the tribunal heard.</p>
<p>Simon McMillan, a partner at Beresfords Solicitors, said: &#8220;This is a matter that concerns two former partners who left the business over 12 months ago.</p>
<p>&#8220;They will no doubt be carefully considering their options as to what steps to take to clear their names.&#8221;</p>

			<content:encoded><![CDATA[<h2>Cristiano Ronaldo has accepted &#8220;substantial&#8221; libel damages over an untrue newspaper allegation that he had gone on a &#8220;bender&#8221; at a Hollywood nightclub.</h2>
<p>The former Manchester United star also received an apology at the High Court in London over claims published in the Daily Mirror in July last year.</p>
<p>The court heard the newspaper had reported that the winger had &#8220;gone on a bender&#8221; in Los Angeles while he recovered from an ankle operation.</p>
<p>Ronaldo does not drink alcohol.</p>
<p>In a statement issued through his solicitor, he said: &#8220;I am delighted with this outcome.</p>
<p>&#8220;I take training and recovery from injury very seriously and would never have &#8216;gone on a bender&#8217; and danced in a nightclub without my crutches as the Mirror falsely claimed.&#8221;</p>
<p>The article, entitled &#8220;Ron The Lash&#8221; was published with a photograph of Ronaldo on crutches in Los Angeles.</p>
<p>He had travelled there to attend a sports award ceremony.</p>

<p>The paper said the star had splashed out £10,000 at a nightclub on champagne and vodka for friends and models, having himself already drunk four glasses of red wine earlier in the evening over a meal.</p>
<p>QC Ronald Thwaites told the court: &#8220;The report said that later on in the nightclub he drank a number of vodka and sodas before switching to bottles of champagne.</p>
<p>&#8220;It described how one clubber claimed to have seen him throw his crutches down on the floor and try to dance on his uninjured foot.&#8221;</p>
<p>Mr Thwaites continued: &#8220;In fact, the truth is that the events did not happen as reported.</p>
<p>&#8220;Although the claimant was in LA and he did attend the nightclub in question, he did not drink any alcohol at all whilst there.</p>
<p>&#8220;He does not drink alcohol because he takes his health, fitness and recovery from injury very seriously.</p>
<p>&#8220;Nor did he throw his crutches to the floor and try to dance.</p>

<p>&#8220;The defendant accepts that the allegations are false and ought never to have been published.</p>
<p>&#8220;It is therefore happy to set the record straight and to apologise to the claimant.&#8221;</p>
<p>In his statement, Ronaldo said: &#8220;I felt I had no choice to begin and pursue these legal proceedings.</p>
<p>&#8220;I would like to thank Sir Alex Ferguson and the others who were ready to appear as witnesses along with me at the trial which had been due to start today.&#8221;</p>
<p>Ronaldo has missed several recent matches for his current club Real Madrid due to injury.</p>
